A Utah court labeled two children criminals because they had sex.
Under a Utah law which criminalizes sex with someone under the age of 14, two children, a 13 year old girl and a 12-year old boy who had consensual sex with each other in 2003, have both been convicted of sexual abuse of a child for the same act.
Opposing Views reports that the girl, who is now 23, is trying to get that conviction overturned; she alleges that two 16-year olds who have sex are not criminalized if they have sex with someone their own age and therefore younger children should not be either.
Her lawyer asserts: ”A child [victim] cannot also be a perpetrator in the exact same act.”
A ruling will be issued at a later date.
