A man wants $100,000 for emotional distress after finding pornographic images on his phone.
Arsen Garibyan of Pasadena, California was disturbed to discover that the “new” telephone he had just purchased had pornographic images and videos taken on it of the sales personnel from the store where he had bought the phone.
To make matters worse, Garibayan claims his 5-year old son discovered the images, “full-body naked as well as genital-focused graphic pictures and videos,” according to the lawsuit.
He has filed a lawsuit against Sprint Corp. and Nextel of California alleging breach of contract, fraud, breach of the implied warranty of merchantability and negligent infliction of emotional distress.
According to CBS Los Angeles, Sprint contends that the sales personnel responsible for the incident were not Sprint employees, they were merely sales people at a store that sold Sprint phones.
